The difference between an Acknowledgment or a Jurat certificate

AcknowledgmentThe form most frequently completed by the notary public is the certificate of acknowledgment. The certificate of acknowledgment must be in the form set forth in Civil Code section 1189. In the certificate of acknowledgment, the notary public certifies:

  • That the signer personally appeared before the notary public on the date indicated in the county indicated;
  • To the identity of the signer; and
  • That the signer acknowledged executing the document.

Jurat 

A jurat is used when the signer is swearing to the content of the document.  The notary must administer an oath or affirmation to the signer in order to complete the jurat. A jurat also requires that the signer signs in the presence of the notary.  The wording states “Subscribed and sworn to before me…” – subscribed meaning “signed” and sworn meaning that an oral oath or affirmation was given.  “Before me” means that both were done in the presence of the notary public.

A jurat requires the following steps:

1. The signer must appear in person before you and sign the document in your presence.
2. The notary must identify the signer
3. The Notary must administer a spoken oath or an affirmation, and the signer must respond out loud. Silent answers such as a nod of the head are not acceptable.
